Who is the Employee?

An employee is someone who gets paid to work for a person or company. Workers don't need to work full time to be considered employees—they simply need to be paid to work by an employer (the person or business that pays them).

Definition of Employee in Different Statutory

1. Employment Act 1955

“Employee” refers to anyone earning less than RM 2,000.00 per month, as well as all manual workers, regardless of their pay.

2. Income Tax Act

“Employee’’ is a servant who is employed by the master subsist, he/she is the one who holds the appointment of service.

3. EPF Act 1991

An “employee” is a person who is employed under a contract of service to work for the employer, either in writing or orally, and who does not fall under the first schedule of the EPF Act.

4. SOCSO Act 1969

“Employee” is a person who is employed under a contract of service with an employer either in a written or oral agreement.

5. Employment Insurance System

“Employee” is a person who is employed under a contract of service in the public sector with an employer either in a written or oral agreement.

6. HRDF

“Employee” is a person who is a Malaysian citizen and is employed under service of contract, but it is excluded for those who is employed as domestic servant.

In a conclusion, “employee” is an individual who was paid to perform a specific job which was bounded by contract of services.

New Minimum Wages Order effective 1 May 2022...Employers with less than 5 employees are exempted.

Minimum Wages Order 2022 was gazetted on 27 Apr 2022. Minimum wages increase to RM1,500 from 1 May 2022. There is a temporary exemption for employers with less than 5 employees until 31 December 2022 (not applicable to the professional service industry).

Key salient points from the Order as below :

1)On 27 April 2022, the Minister, in the exercise of the powers conferred by section 23 of the National Wages Consultative Council Act 2011 [Act 732], Gazette the Minimum Wages Order 2022 [P.U. (A) 140].

2)This Order shall not apply to a domestic servant as defined under subsection 2(1) of the Employment Act 1955 [Act 265], subsection 2(1) of the Sabah Labour Ordinance [Cap. 67] and subsection 2(1) of the Sarawak Labour Ordinance [Cap. 76].

3)The Minimum Wage of RM 1,500 will come into effect on 1 May 2022 for the following two types of employers.:-

a) an employer who employs five or more employees; and

b) regardless of the number of employees employed, an employer who carries out a professional activity is classified under the Malaysia Standard Classification of Occupations (MASCO) as published officially by the Ministry of Human Resources.

4.1) If the employee is paid on a daily basis, the Minimum Wage will be as follows:-

a) 6 working days in a week - RM 57.69 per day

b) 5 days in a week - RM 69.23 per day

c) 4 working days in a week - RM 86.54 a day

4.2) if the employee is paid on an hourly basis, the wage is not less than RM 7.21 per hour

5.1) For employers employing less than 5 employees, the Minimum Wage of RM 1,500 will come into effect on 1 January 2023

5.2) For Employer with less than 5 employees that do not carry out a professional activity classified under the Malaysia Standard Classification of Occupations (MASCO), the Minimum Wage will be as per the Previous Order until 31 December 2022, i.e.

a) Place of employment is in the City Council or Municipal Council area - RM 1,200

b) Place of employment is located at Other than City Council or Municipal Council area - RM 1,100

6. In addition to the Minimum Wages Order 2022 [P.U.(A) 140/2022], we have also compiled a list of past Minimum Wage Orders and the Malaysian Standard Classification of Occupations.

The Malaysian Standard Classification of Occupations.

1) The Malaysia Standard Classification of Occupations (MASCO) is a national benchmark for the classification of occupations in the employment structure of the country.

MASCO has been developed in accordance with the International Standard Classification of Occupations (ISCO) with changes and modifications to meet the needs of the country.

MASCO lists down the descriptions and tasks as well as the code for each position listed.

It contains ten categories of major groups, namely:

  • Major Group 1: Managers

  • Major Group 2: Professionals

  • Major Group 3: Technicians and Associate Professionals

  • Major Group 4: Clerical Support Workers

  • Major Group 5: Service and Sales Workers

  • Major Group 6: Skilled Agricultural, Forestry, Livestock, and Fishery Workers

  • Major Group 7: Craft and Related Trades Workers

  • Major Group 8: Plant and Machine Operators and Assemblers

  • Major Group 9: Elementary Occupations

  • Major Group 0: Armed Forces

1. What is Form EA?

Form EA is a yearly statement of remuneration for the employees.

 

2. Who is employee?

The employee has included full time, part time, contract employees and interns.

 

3. Does the employee include the foreign employees?

Yes, companies need to prepare Form EA for foreign employees.

 

4. Does the company required to prepare Form EA for the owner of sole proprietors and partners of a partnership?

No, the owner of sole proprietors and partners of a partnership is considered the owner of the company.

 

5. Does the company required to prepare Form EA to the director of the company?

Yes, director is treated as one of the employees of the company.

 

6. Does the company required to prepare Form EA to the partners of Limited Liability Partnership (LLP)?

Yes, partner of LLP is treated as one of the employees of the company.

 

7. How to fill in the number of children qualified for tax relief?

The number of children qualifies for tax relief is according to the monthly PCB calculation.

 

8. An employee who got married on 24 June 2021, and his wife is working, which category does the employee belong to?

The employee is in to Category 3 (Married and husband or wife is working).

 

9. Which period does the Form EA indicate the income for?

It indicates the calendar year (01/01/2021-31/12/2021) income.

 

10. What type of income need to report under Form EA?

Paragraph 13 (1) (a) – Monetary Benefits

Example: Wages, salary, remuneration, bonus, leave pay, overtime pay, commission, fee, gratuity, tip, tax allowance, perquisites, reward or allowance (whether in money or otherwise).

 

Paragraph 13 (1) (b) – Benefits in kind (Benefits not convertible into money)

Example: Motor vehicle, leave passage, driver, gardener, household servant & etc.

 

Paragraph 13 (1) (c) – Living of Accommodation (VOLA)

Example: Living accommodation provided for the employee by his employer.

 

Paragraph 13 (1) (d) – Withdrawal from unapproved pension fund

Example: Amount received by the employee from an unapproved pension or provident fund, scheme or society (employer’s portion only) as would not have been so received if his employer had not made contributions in respect of the employee to the fund, scheme or society or its trustees.

 

Paragraph 13 (1) (e) – Compensation for loss of employment

Example: Amount received by the employee by way of compensation for loss of the employment, whether before or after his employment ceases.

We shall explain the important differences between Contract of Service and Contract for Service.

Contract of Service

  • A contract of service is also known as an employment contract. Meanwhile, the roles in the contract agreement are like “Employer & Employee”.

  • The contract agreement can be oral, written, express, or implied.

  • Terms of termination under employment act 1955.

Contract for Service

  • A contract for service can be known as a contract between an independent contractor or sub-contractor providing services to the client. The services could be an assignment or project.

  • The contract agreement is usually in writing.

  • Follow the terms & conditions stated in the agreement.

What are the statutory benefits - Contract of Service

  • Wage period will be one month and the payment of wages cannot be later than the seventh day after the last day of the wage period.

  • The wages must include lawful deductions such as EPF, SOCSO, EIS and PCB.

  • Working hours will be 8 hours a day and total more than 48 hours a week.

  • General paid annual leave, paid sick leave and holiday.

  • Termination, lay-off and retirement benefits.

  • Maternity protection

What is the statutory benefit - Contract for Service

No statutory benefit for independent contractors and sub-contractors. Only follow the terms and conditions stated in the contract agreement.

Example - Contract of Service

ABC Sdn Bhd is a manufacturing company. They hire an internal worker to do the daily cleaning job in the factory. The company and worker have signed an employment contract. This worker also can enjoy the EPF, SOCSO, EIS, and paid leave which are provided by ABC Sdn Bhd. This kind of relationship between employer and employee will be a contract of service.

Example - Contract for Service

ABC Sdn Bhd is a manufacturing company. They engaged a sub-contractor to provide cleaning services for the factory once a week. ABC Sdn Bhd only paid the cleaning fee and without EPF, SOCSO & EIS to the sub-contractor which was agreed and stated in the signed contract. This kind of relationship between contractor and client will be a contract for service.


Summary Contract of Service

  • Has employer-employee relationship

  • The employee does business for the employer

  • Covered by the Employment Act

  • Includes terms of employment such as working hours, leave benefits, etc.

Summary Contract for Service

  • Has client-contractor type of relationship

  • The contractor does business for their own account

  • Not covered by the Employment Act

  • Statutory benefits do not apply

What is Program JaminKerja?

A financial incentive is given to employers who make new hires starting January 1, 2022 among apprentices, graduates, vulnerable groups including the disabled, ex -soldiers, ex -prisoners, the elderly and the unemployed.

The government would continue with hiring employees under the JaminKerja wage incentive through the SOCSO with a target of 300,000 employees.

Eligible employee hiring:

1. Apprentice (age 18-30 for executive position only)

  • RM900 incentive from month 1-6

  • Minimum salary RM1,500 with contract 6 month

2. General job seeker (age 16-50 & unemployed for least 60 days)

  • 20% on salary from month 1-6 & 30% on salary from month 7-12

  • RM1,500 with contract 12 months

3. Vulnerable groups (Unemployed at least 180 days, orang asli, ex-army, OKU, age above 50, ex-criminal & etc)

  • 30% on salary from month 1-6 + 40% on salary from month 7-12

  • RM1,200 with contract 12 months

4. Female employees (Unemployed at least 6 months, single mother & etc)

  • 30% on salary from month 1-6 & 40% on salary from month 7-12

  • RM1,200 with contract 12 months

5. Tourism related sectors

  • 30% on salary from month 1-6 & 40% on salary from month 7-12

  • RM1,500 with contract 12 months

6. Replacing foreign workers/expats

  • 20% on salary from month 1-6 & 30% on salary from month 7-12

  • RM1,200 –RM3,000 with contract 12 months

Ineligible Employees

1. Employees receiving Hiring Incentives 3.0

2. Non-Malaysian Citizen

3. Intern or student who haven't graduated

4. Employees who leave voluntarily (unless unemployed for more than 2 months or unemployed for long-time period).

5. Hire employees with family relationships, including parents, spouses, siblings, children and other relatives.

Eligible Employer

1. Registered SOCSO before 01 January 2022

2. Employers from public sectors, federal and state statutory bodies, local government are only eligible for the ''apprentice'' category.

3. Employers are required to pay wages together with SOCSO and EPF contribution on time.

Ineligible Employers

  1. Private employment agencies or outsourcing companies.

WSP 5.0 is only for Tourism industry. No salary restriction according to the FAQ of “SIP Subsidi Upah Bersasar Pertubuhan Keselamatan Sosial (Perkeso)” which issued by PERKESO on 30 December 2021.

- Yes, employer has to submit new application through Perkeso website prihatin.perkeso.gov.my.

7. What type of documents are required for new application?

- Employee listing (follow the standard format in PERKESO website);

- Employer’s bank account information (copy of first page of the bank statement);

- Letter of Business Registration Number (BRN) (normally used to open the company bank account);

- SSM/ROS/ROB/relevant local authority registration certificate;

- Declaration form of WSP5.0

What is the meaning of HRDF?

The HRDF is an abbreviation of the term Human Resource Development Fund. This is a pool of funds collected from the various companies and manufacturers that come under the HRDF act. The funds are collected as levies from the employers of the manufacturing and service sectors, and the registered companies

Newly Registered Employers under First Schedule of PSMB Act 2001

Exemption of HRDF levy payment extend to 31.12.2021 (6 months) HRDF Exemption.

January 2022

The levy payment on this newly registered employers under the First Schedule of the PSMB Act 2001 start from January 2022. The payment is due on 15th February 2022.

10% penalty on late payment charges will be imposed on any payment before the due date.

大马半岛人力局总监阿斯里拉曼披露,该局在今年2月至11月的检举行动中,发现多达

50.18%雇主(1万7105个)没有遵守《2021年员工房屋、住宿和设施基本标准(修正)法令》(446法令),开出总额914万9000令吉的罚单。

他表示,接受检查的3万4088个雇主,将7万1719名本地员工和93万8508名外籍劳工安置在15万185个宿舍,其中大部分雇主没有申请宿舍认证。

How to claim EIS?

Submit the application within 60 days of loss of employment.. You can either apply for EIS PERKESO online or manually at the nearest PERKESO office.

Step by step on EIS application

  • Fill in the application form and attach the relevant documents

  • Bring all original documents when meeting PERKESO officers.

  • Check and save the application slip for future reference after submission.

  • Payment will be made to your account upon the approval of the application.

  • You will need to participate in the Re-Employment Placement Programm within 7 days of receiving notification from SOCSO.

  • You must report on your job status to SOCSO monthly.

Documents required for EIS application

  • Copy of identity card (NRIC)

  • Proof of loss of employment (including VSS, MSS and others).

  • Copy of bank account.

  • Copy of last 6-month salary slip

Can SOSCO help if I am jobless?

You can claim SOSCO Employment Insurance System.

The Employment Insurance System Act covers all workers who are

  1. Malaysian citizens / permanent residents

  2. Aged 18-60*

  3. Working in the private sector**

  4. Employed based on a contract of service

* Important exception: Workers aged 57 and above who have never paid contributions before that age are NOT covered by the EIS Act and are NOT required to contribute

** The EIS Act does NOT cover domestic workers, the self-employed, civil servants, and workers in local authorities and statutory bodies.

To successfully apply for benefits, employees covered by the EIS Act should fulfill the following conditions:

  • Apply within 60 days after their Loss of Employment (LOE).

  • Meet our Contributions Qualifying Conditions (CQC) (i.e. must have paid contributions to SOCSO EIS for a minimum number of months within a specified period)

  • Be unemployed under our definition of Loss of Employment (LOE)

The definition of Loss of Employment (LOE) includes:

  • Normal retrenchment and redundancy

  • VSS/MSS (Voluntary/Mutual Separation Scheme)

  • Closure of the company due to natural disasters

  • Bankruptcy or closure of the company

  • Constructive dismissal

  • Resignation due to sexual harassment or threats made in the workplace

  • Resignation after being ordered to perform dangerous duties that are not within the job scope

The following CANNOT be accepted as Loss of Employment (LOE):

  • Dismissal due to misconduct by the employee

  • Voluntary resignation

  • Retirement

  • The expiry of a fixed-term contract (includes unconditional termination of a contract based on an employer-employee agreement or the completion of the project stated in the contract)

2)出席津贴(Constant-Attendance Allowance)

职场感染冠病者无法工作,家人可以获得每个月RM500的津贴来补贴日常开销,直到感染冠病者康复出院。

3)永久性失去工作能力 (Permanent Disablement Benefit)

职场感染冠病者永久性失去工作能力,雇主可以向社会保险机构申请高达90%的津贴。

4)丧礼福利金 (Funeral Benefit)

若确诊者不幸因为covid-19病逝,家属可向PERKESO社会保险机构索取RM2,000一次性丧礼福利金。

Employment Injury Scheme covers the following :

1. The accident while doing its job

Accidents are encountered while at work or while on a business day.

2. Commuting accident

On a route between his place of residence or stay.

3. Accident during emergency

Accident which occurs during an emergency at the employer’s premises while in the course of assisting, rescuing, or protecting other people from disaster or danger during an emergency.

4. Occupational diseases

Diseases resulted from his occupation as described in the Fifth Schedule of Employees’ Social Security Act 1969.

What are the benefits of the Employment Injury Scheme

This scheme provides coverage and protection for employees who suffer from employment injury.

1. Medical benefits

Employees suffering from employment injuries or occupational diseases may receive free medical treatment at panel clinic or hospital until they are fully recovered.

2. Temporary disablement benefit.

Temporary Disablement Benefit is paid for the period the employee is on medical leave certified by a doctor for not less than 4 days.

3. Permanent disablement benefits.

Employees who suffer from permanent disability due to employment injury can apply for this benefit.

4. Constant-attendance allowance.

This allowance is paid to an employee who is suffering from total permanent disablement require the personal attendance of another person.

7. Funeral benefits

The amount paid will be the actual amount incurred or RM2,000 whichever is lower.

8. Education benefits.

This benefit is in the form of loans may be provided to a dependent child of an insured person
